Right to unilateral termination of contract and return of goods

The buyer has the legal right to unilaterally terminate the contract, without stating a reason, within 14 (fourteen) days from the date of delivery of the product purchased remotely. The seller voluntarily extends this period by an additional 16 days, making it 30 (thirty) days. The buyer does not have the right to unilaterally terminate the contract if:

• the contract for services has been fully performed by the trader, and the performance began with the consumer's explicit prior consent and with their acknowledgment that they are aware that they will lose their right to unilaterally terminate the contract from this section if the service is fully performed
• the subject of the contract is goods or services whose price depends on fluctuations in the financial market that are beyond the trader's control and that may occur during the consumer's right to unilaterally terminate the contract
• the subject of the contract is goods made to the consumer's specifications or clearly personalized for the consumer
• the subject of the contract is sealed goods that are not suitable for return for health or hygiene reasons, if they were unsealed after delivery
• the consumer specifically requested a visit from the trader to perform urgent repairs or maintenance work, provided that if, during such a visit, in addition to the services explicitly requested by the consumer, the trader also provides other services or delivers other goods beyond what is necessary for urgent repairs or maintenance work, the consumer has the right to unilaterally terminate the contract for those additional services or goods

If the consumer is not informed of the right to terminate the contract, the consumer's right to unilaterally terminate the contract expires after 12 months from the expiry of the 14-day period. 

If the buyer orders multiple pieces of products in a single order that are to be delivered separately, or if it is a matter of goods delivered in multiple pieces or multiple shipments, the 30-day period begins to run from the day when the last piece or last shipment of products was handed over to the buyer or a third party designated by the buyer, who is not the carrier.

If regular delivery of goods is agreed upon for a certain period, the 30-day period begins to run from the day when the first piece or first shipment of products was handed over to the consumer or a third party designated by the buyer, who is not the carrier.

In order for the Buyer to exercise the right to unilaterally terminate the contract, they must inform the Seller of their decision to unilaterally terminate the Contract before the deadline expires. The Buyer can inform the Seller of their decision to unilaterally terminate the contract before the deadline by an unequivocal statement in which they will state their name and surname, address, telephone number or e-mail address, and can also use the attached sample form for unilateral termination of the contract. The user can send the statement by mail to the address DR.L Shop d.o.o., Kostelgradska 6, 49218 Pregrada, or by e-mail to prodaja@dr-luxus.hr, in which they will state their name and surname, address, telephone number or e-mail address, and can, at their own discretion, also use the sample form for unilateral termination of the contract attached below. The buyer can fill out the sample form for unilateral termination of the contract electronically by clicking here. The seller will confirm receipt of the statement of unilateral termination of the contract to the consumer without delay, by e-mail.

If the Buyer unilaterally terminates the Contract, they will be refunded the money received from them, including delivery costs, if any, without delay, and no later than 14 (fourteen) days from the date when the Seller receives the Buyer's decision to unilaterally terminate the Contract and return the product, unless the Buyer has chosen another type of delivery, which is not the cheapest standard delivery offered. The refund will be made in the same way that the Buyer made the payment (card - refund to card, cash on delivery - refund to bank account). In the event that the Buyer agrees to another method of refunding the paid amount, they do not incur any costs in relation to the refund. The Seller can only make a refund after the goods have been returned to them.

The buyer is obliged to send the goods to the address DR.L Shop d.o.o., Kostelgradska 6, 49218 Pregrada, without undue delay, and in any case no later than 14 (fourteen) days  from the day when they sent their decision on unilateral termination of the Contract to the Seller. The buyer must bear the direct costs of returning the goods themselves.

The Buyer is responsible for any reduction in the value of the goods resulting from handling the Product, other than what was necessary to determine the nature, characteristics, and functionality of the Product. In order for the consumer to determine the nature, characteristics, and functionality of the Product, they may handle and inspect the Product only in the manner customary when purchasing in physical stores. During the period in which the consumer exercises the right of return, they must handle the goods with due care.

In the event of a reduction in the value of the product resulting from excessive handling of the Product, the Seller will assess the reduction in the value of the Product taking into account the objective criteria of each individual case and will inform the Buyer accordingly.

If, at the Buyer's request, the performance of the service began during the period for unilateral termination of the Contract, the Buyer is obliged to pay the Seller an amount proportionate to what was delivered until the moment the Buyer informed the Seller of the unilateral termination of the Contract.

When the buyer is a legal entity, the section of these General Terms and Conditions of Business entitled "Unilateral termination of contract and return" does not apply to them. For legal entities, the Law on Obligations and the Law on Electronic Commerce apply.
